ASSET TRANSFER UNDER THE COMMUNITY EMPOWERMENT ACT
NOTICE OF RQUEST FOR REVIEW OF THE REFUSAL OF THE ASSET TRANSFER REQUEST
Application CAT/24/0017
On 15th November 2024 an asset transfer request was made to South Lanarkshire Council under Part 5 of the Community Empowerment (Scotland) Act 2015.
The request was made by Healthy Valleys and related to the former care home Mcclymont House, 1 Smiddy Court, Lanark, ML11 7NZ.
The request was for a 20 year lease of the property and the proposed use of the building was for a Community Hub.
On 28th February 2025 South Lanarkshire Council issued a decision notice refusing the asset transfer request.
On 16th May 2025 at the request of Healthy Valleys a review was undertaken by South Lanarkshire Council on their decision, and the original findings were upheld.
Healthy Valleys have now submitted a request for an appeal of that decision to the Scottish Ministers.
Copies of representations previously made will be considered by the Scottish Ministers when determining the review.

Further representations can be made to the Scottish Ministers by those parties that previously commented on this asset transfer request, or review. Representations must be in writing and include the name and address of the person making it. A copy of the representation will be given to the organisation making the request for their consideration.
